The alleged drunk driver accused of killing Columbus Blue Jackets winger Johnny Gaudreau and his brother, Matthew, was denied bail on Friday.
Sean M. Higgins, the 43-year-old, was seen breaking down into tears after the judge ordered him to remain in jail until his trial, the New York Post reported.
He would appear in court virtually from a Salem County jail.
Higgins will be allowed to appeal the decision, but will be ordered to appear in court again next month regardless of the appeal decision, Judge Michael Silviano said.
A Jeep Grand Cherokee driven by Higgins struck Columbus Blue Jackets winger Johnny Gaudreau and his brother, Matthew, while he was attempting to pass another SUV on the right that had moved over to make room for the pedal cyclists in Oldmans Township.

The driver charged with killing NHL hockey player Johnny Gaudreau and his brother Matthew while they were on bikes had a blood-alcohol level of .087, above the .08 legal limit in New Jersey, a prosecutor said Friday.
The driver, 43-year-old Sean M. Higgins, is charged with two counts of death by auto, along with reckless driving, possession of an open container, and consuming alcohol in a motor vehicle.
Johnny Gaudreau and his brother Matthew were tragically mowed down near their childhood home in South Jersey on Aug. 29th.
