Former NFL quarterback Brett Favre seems sure he will not face criminal misconduct charges as a result of his involvement in the Mississippi welfare scandal. But he is facing a civil case.
According to A.J. Perez of FrontOfficeSports.com, the Hall of Famer’s attorneys have revealed that he will not invoke the Fifth Amendment rights that would protect him from incriminating himself when he gives his testimony in the civil suit.
The revelation came about as a result of the lawyers attempting to counter an effort made by three other defendants to stay the civil case based on what happens with their criminal cases.
“Favre would be severely prejudiced by a stay,” his lawyers wrote in a statement. “A stay under these circumstances would unduly delay Favre’s opportunity to have his day in court and clear his name.”
This is going to be tricky as anything the former QB says in an attempt to clear his name in the civil matter could be used against him in a potential criminal case. It could also prompt an investigation into whether he avoided telling the truth while under oath.
Should he plead the Fifth, he’s very likely to lose as he would not be able to oppose the evidence brought against him.

Favre has maintained he is innocent to this point, even taking legal action against persons in the media who have suggested otherwise.
