The State of Alabama will not seek the death penalty in a case involving a former Alabama basketball player who is charged with capital murder.
Former Crimson Tide basketball player Darius Miles awaits trial after being charged with the murder of a young Alabama woman. Miles and Michael Davis face capital murder charges for their roles in the killing of 23-year-old Jamea Harris. Miles is alleged to have owned the gun, while Davis is claimed to have pulled the trigger.
The maximum sentence that Miles could face according to prosecutors is life in prison without the possibility of parole.
His lawyers are claiming he is immune from prosecution since he acted in self-defense under Alabama law.
Per Nick Kelly of the Tuscaloosa News:
In the immunity hearing, Miles’ attorneys would have the opportunity to argue in front of a judge that Miles acted in self-defense, made possible through Alabama’s stand-your-ground law. If the attorneys succeed, the judge could dismiss the cases against Miles.

One 911 call made by an eyewitness of the shooting was played for the judge as it showed a woman claiming to have seen who fired the first shot and said he was wearing a red and black plaid flannel shirt before fleeing the scene.
Former Alabama freshman basketball standout Brandon Miller brought a teammate the handgun that was used to kill that woman but he has not been charged with any crime. He has since been drafted into the NBA by the Charlotte Hornets.
The 6-foot-6 forward played three seasons at Alabama where he appeared in 53 games and averaged 4.2 points and 2.3 rebounds for his career.
