Erica Herman badly wants an NDA she signed to be gone, but the courts are not siding with her. Herman’s plea to a federal judge to reconsider her case against Tiger Woods has been denied.
Elizabeth Metzger ruled against the 38-year-old last month, ordering their dispute be settled by arbitration as agreed by the terms of an NDA she signed in 2017.
Herman then filed a request with the state court to reconsider her case against Woods.
Herman’s lawyer questioned the legitimacy of the NDA, claiming that she didn’t even remember signing it and that her signature might have been forged.
Herman’s attorney, Benjamin Hodas, claimed in court papers that Woods “could not meet his burden to establish the contract he seeks to enforce” and that various concerns had been missed.
According to a report from USA Today, Judge Elizabeth Metzger denied Herman’s attempt.
“The Court, having reviewed the Motion and being otherwise fully advised in the premises, hereby orders and adjudges that the motion is denied,” the judge wrote.

“The lawsuit against the trust remains pending in state court, though Metzger soon could send that dispute to arbitration as well, pursuant to the terms of the same NDA.”
Herman’s legal action against the golfer all stems from their nasty breakup which she alleged she was ‘tricked’ out of Woods’ mansion for a vacation, only to be told the 15-time major champion was finished with her and she had been locked out.
She first took legal action in 2022 when she sued the trust held by the golfer, seeking $30m in damages. She claimed at the time she had an ‘oral tenancy agreement’ to live there for several more years. Woods claimed he had offered Herman a place to live after the split but denied having any such agreement.
Lawyers for Woods claimed she was a ‘jilted ex-lover.’
After this latest ruling, she might be even more jilted.
